1. Acceptance of Terms
By accessing or using the services provided by Coral Pottery ("we," "us," or "our"), including pottery classes, workshops, artist residency programs, and Koh Mak experiences, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Coral Pottery offers the following services:
- Pottery Classes: Basic throwing, hand forming, duo technique, ceramics workshops
- Specialized Workshops: From clay to matcha, bisque paint color, and custom experiences
- Artist Residency Program: Private oceanfront bungalow accommodation together with studio access, available year-round from a one-week minimum stay
- Koh Mak Experiences: Pottery classes combined with island tourism activities
- Cultural Immersion: Thai ceramic heritage education and cultural programs
3. Booking and Payment Terms
3.1 Reservations
- All bookings must be made in advance through our website, email, or phone
- Residency bookings are confirmed the moment the reservation fee is paid. There is no application to be accepted or declined
- Workshops and classes are confirmed on receipt of payment
3.2 Payment
- Payment must be made in Thai Baht (THB) unless otherwise specified
- We accept credit cards, bank transfers, and cash payments
- Artist residency bookings require a reservation fee of 3,000 THB, paid at the time of booking. This fee is part of the total price, not an addition to it, and the balance is paid on arrival
- The reservation fee is non-refundable. See section 4.1
- Artist residency rates vary by season: Green season (19 April to 22 October) and High season (23 October to 18 April)
- Discounts and special rates are arranged with us directly and are not applied automatically to online bookings
- All prices are subject to change without notice
3.3 Additional Costs
Class and workshop participants are responsible for additional costs including but not limited to accommodation, meals (unless specified), materials beyond basic supplies, firing of additional pieces, and transportation to/from our studio.
Artist residency rates include private bungalow accommodation and full participation in the residency programme, including studio access. Kiln firing fees for high-volume work are billed separately.
4. Cancellation and Refund Policy
4.1 Participant Cancellations
- Workshops (1-3 days): 48 hours notice for full refund, 24 hours notice for 50% refund, no refund for same-day cancellations
- Extended Programs (1+ weeks): 7 days notice for 90% refund, 3-6 days for 50% refund, less than 3 days for 25% refund
- Artist Residency: the 3,000 THB reservation fee is non-refundable at any notice. Because the balance is only paid on arrival, cancelling before you arrive costs you the reservation fee and nothing more. If you need to shorten or change a stay after arriving, talk to us and we will work it out with you
4.2 Our Cancellations
We reserve the right to cancel classes due to insufficient enrollment, instructor illness, weather conditions, or force majeure events. In such cases, participants will receive a full refund or credit toward future classes.
4A. Right of Withdrawal (EU and UK guests)
Accommodation booked for specific dates is exempt from the 14 day right of withdrawal that normally applies to purchases made online. This follows Article 16(l) of Directive 2011/83/EU and, for guests in Germany, section 312g(2)(9) of the German Civil Code (BGB).
In plain terms: once you have paid the reservation fee for a residency on chosen dates, there is no automatic cooling off period. The cancellation position in section 4.1 is what applies, and it is shown to you before you pay.
This does not affect your rights if we cancel, or if what you receive is not what was described.
5. Health and Safety Requirements
5.1 Health Disclosure
Participants must disclose any medical conditions, allergies, or physical limitations that may affect their ability to participate safely in pottery activities. We reserve the right to exclude participants who cannot safely participate.
5.2 Safety Guidelines
- Participants must follow all safety instructions provided by instructors
- Closed-toe shoes are required in the studio
- Long hair must be tied back during wheel throwing
- Participants must wash hands before handling food or touching face
- Children under 12 must be supervised by an adult at all times
6. Participant Conduct
Participants agree to:
- Treat instructors, staff, and other participants with respect
- Follow studio rules and safety guidelines
- Not engage in disruptive behavior or use offensive language
- Respect cultural customs and traditions
- Not use substances that impair judgment or coordination
- Care for studio equipment and materials responsibly
7. Liability Limitations
7.1 Assumption of Risk
Participants acknowledge that pottery activities involve inherent risks including but not limited to cuts, burns, allergic reactions, and muscle strain. Participation is at your own risk.
7.2 Limitation of Liability
To the maximum extent permitted by law, Coral Pottery's liability is limited to the amount paid for services. We are not liable for indirect, incidental, or consequential damages including but not limited to lost profits, emotional distress, or travel expenses.
8. Insurance
We strongly recommend that all participants, especially international visitors and residency participants, obtain comprehensive travel and health insurance. We are not responsible for medical expenses or travel-related costs.
9. Intellectual Property
9.1 Your Creations
Participants retain ownership of pottery pieces they create. However, we reserve the right to photograph and display works for educational and promotional purposes.
9.2 Our Content
All instructional methods, techniques, and materials provided by Coral Pottery are proprietary. Participants may not reproduce, distribute, or commercialize our teaching methods without written permission.
10. Photography and Video Consent
By participating in our programs, you consent to being photographed and recorded for promotional and educational purposes. These images may be used in our marketing materials, website, and social media. If you do not consent, please notify us in writing before your program begins.
11. Artist Residency Specific Terms
11.1 Booking a Residency
- Residencies are booked online. Paying the reservation fee confirms the booking; there is no separate acceptance step
- We ask about your practice and what you hope to get out of the time here. These questions help us prepare for you and are not a condition of booking
- A portfolio link is welcome but optional
11.2 Residency Requirements
- Residencies run year-round, across two seasons: Green season (19 April to 22 October) and High season (23 October to 18 April)
- Minimum stay of one week, maximum of 6 months
- Participation in cultural activities and community events
- Contribution to our permanent collection (one piece)
- Presentation or workshop for local community
12. Force Majeure
We are not liable for delays or cancellations due to circumstances beyond our control including but not limited to natural disasters, political unrest, pandemics, transportation strikes, or government actions. In such cases, we will work with participants to reschedule or provide alternative arrangements when possible.
13. Dispute Resolution
Any disputes arising from these terms or our services will first be addressed through good-faith negotiations. If resolution cannot be reached, disputes will be resolved through arbitration in Trat Province, Thailand, under Thai law.
14. Governing Law
These Terms of Service are governed by the laws of Thailand. Any legal proceedings must be brought in the courts of Trat Province, Thailand.
15. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website and take effect immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
